About Arthur

Arthur S. Gaus defends California employers in single plaintiff and representative employment actions in all phases including pre-litigation, litigation, trial and appeals in both California and Federal Courts.

Arthur defends and manages factually complicated and legally sophisticated Labor Code actions arising out of the Private Attorney General Act (PAGA) as well as traditional class actions. He also has extensive experience litigating individual claims of harassment, discrimination and workplace retaliation arising under California’s Fair Employment and Housing Act, Title VII and the Americans with Disabilities Act. In the traditional labor sector, Arthur has also defended employers before the National Labor Relations Board (NLRB) and in the grievance-arbitration setting.

Arthur advises California employers on claim prevention and mitigation. Regarding the counseling practice as an essential component to a cost effective defense, he takes a fact-intensive and creative approach to integrating compliance and best practices into a successful litigation and post-litigation posture. His clients include elder care facilities, retail, construction, technology and manufacturing.

Arthur’s fact-intensive and creative approach to litigation has produced several notable victories for California businesses including the foundational ADA decision in Whitaker v. Tesla Motors, Inc., 985 F.3d 1173 (9th Cir. 2021).
