Calif. Atttorneys Hopeful About Little-Known Labor Chief Nominee

Corey Cabral, a partner at management-side firm CDF Labor Law LLP, also said employers would like to see the LWDA provide more guidance about how to comply with California's employment laws and regulations.

Cabral pointed out that the state's Private Attorneys General Act allows workers to bring employment suits in the LWDA's name, with the agency collecting 75% of civil penalties recovered in those cases. Some of those funds should be used to help employers understand "highly technical and/or ambiguous requirements" as well as the procedural intricacies of PAGA, said Cabral, who heads CDF's PAGA practice.

"Doing so would be in the best interest of employees, employers and the overburdened judicial system," he said. "Such guidance would increase compliance, promote worker protections and eliminate the need for many PAGA lawsuits."
