Investigating Workplace Misconduct—How to Do It Right |
Employees frequently complain -- about everything from interpersonal conflicts to the snack selections in the vending machine in your lunch room. Which types of employee complaints require formal investigation and action from the company? Once a complaint is received, how do you decide whether it should be conducted internally by your Human Resources Department, outside counsel, or an outside investigator? What are your obligations as an employer when an employee lodges a "confidential" complaint that he or she wants "off the record"? How do you properly document the investigation so the information will be useful in the event of a lawsuit?
